NOTICE OF RESUBMISSION OF THE WATER USE LICENCE APPLICATION
This letter gives notice to potential Interested and Affected Parties (“I&APs”) about where information can be obtained in respect of the resubmission of the Water Use Licence Application (“WULA”) as well as the opportunity for interested and affected parties (“I&Aps”) to comment on the aforesaid application.
BACKGROUND TO THE PROJECT
DMI Minerals South Africa (Pty) Ltd (“DMI”) is the owner and operator of the Krone-Endora operation (“the Project”) located in the Limpopo Province approximately 75 km west of Musina near South Africa’s northern border with Botswana and Zimbabwe. The Project is situated within the Musina Local Municipality and the Vhembe District Municipality and falls within the buffer zone of Mapungubwe National Park (a world heritage site). The DMI Integrated Water Use Licence (“IWUL”) with Licence Number: 01/A63E/ACG/4499 was granted on 17 March 2016 by the Department of Water and Sanitation (“DWS”). The IWUL authorises the following water use activities in terms of Section 21 of the National Water Act, 1998, (Act No. 36 of 1998) (“NWA”): Section 21 (a), (c), (i), and (g).
Relevant environmental audits indicated that the current IWUL requires an update to align with the current water uses on site. DMI hereby resubmits the WULA to authorise all water uses onsite.
LEGISLATIVE REQUIREMENTS
Procedure applied to the application
Given the nature and potential impacts associated with the DMI activities, a Water Use Licence (“WUL”) in terms of the National Water Act, 1998 (Act 36 of 1998), will be applied for with the Department of Water and Sanitation (“DWS”).
Listed activities applies to the application
The resubmission of WULA includes an update of water uses under Section 21 of the National Water Act (Act 36 of 1998). The activities triggered are:
- Section 21(a): Taking water from a water resource.
- Section 21(c) & (i): Impeding or diverting the flow of water in a watercourse & altering the bed, banks, course, or characteristic of a water course.
- Section 21(g): Disposing of water in a manner which may detrimentally impact on a watercourse.
- Section 21 (j) of the Act: removing, discharging, or disposing of water found underground if it is necessary for the efficient continuation of an activity or for the safety of people.
PUBLIC PARTICIPATION
People have a right to be informed about potential decisions that may affect them and to be afforded an opportunity to influence those decisions. This advertisement forms part of a Public Participation Process as part of the Water Use Licence (“WUL”) process. It describes the various components of the project to enable I&APs to get a better understanding of the potential environmental, economic, and social impacts that could be expected from the DMI Project. It also outlines the WUL process and the opportunities for the public to become involved during the study. Public participation will be conducted in terms of GNR 326 of National Environmental Management Act 1998 (Act No. 107 of 1998) (NEMA) Environmental Impact Assessment (“EIA”) Regulations, which provides for the notification and participation of any interested and affected parties.

You may register as an I&AP. To register as an I&AP of this project, or to obtain more information or submit comments, please request a Registration Form from Shangoni and return it together with any comments to Shangoni by no later than 08th January 2024 at the details provided below.
Availability of the Integrated Waste Water Management Plan (IWWMP) technical report
The IWWMP will serve as the technical report of this application and will be made available to the public for review for a period of Sixty (60) days from 20th October 2023 to 08th January 2024. An electronic copy of the draft WWMP will also be posted on the Shangoni’s website (www.shangoni.co.za) for public comment for the same period of sixty days.
