WATER TREATMENT PLANT, SEWERAGE TREATMENT PLANT AND PIPELINES PROJECT

NOTICE OF THE APPLICATION FOR WATER USE LICENCE AND DRAFT TECHNICAL REPORT REVIEW PERIOD FOR THE PROPOSED CONSTRUCTION OF A WATER TREATMENT PLANT (“WTP”), HOLDING DAM (“HD”), SEWERAGE TREATMENT PLANT (“STP”), BRINE MANAGEMENT FACILITIES, SLUDGE DRYING PADS, BRINE SALT STORAGE AREAS AND ASSOCIATED PIPELINES AT NDC IN THE LEKWA LOCAL MUNICIPALITY SITUATED IN MPUMALANGA PROVINCE

Notice is given in terms of Regulation 17 of the Water Use Licence Application, 2017, as amended, promulgated under the National Water Act, 1998 (Act 36 of 1998) (NWA), and in terms of Section 21 of the NWA, for the WTP, STP and Pipelines Project; and the review of the Draft Integrated Water and Waste Management Plan (“IWWMP”) and related documents.

Applicant: Seriti Power (Pty) Ltd: New Denmark Colliery (“NDC”)

Purpose: All Interested and Affected Parties (“I&APs”) are hereby notified of the above application; availability and access to the draft IWWMP. Furthermore, I&APs are afforded an opportunity to submit comments on the application and report.

BACKGROUND TO THE PROJECT

NDC, located approximately 30 km north of Standerton in Mpumalanga, has appointed Shangoni Management Services (Pty) Ltd (“Shangoni”) to undertake a Water Use License Application (“WULA”) for a proposed WTP, HD, STP, Brine Management Facilities, Sludge Drying Pads, Brine Salt Storage Areas and associated pipelines. Existing brine ponds will be utilised for brine storage as part of the WTP system. The project includes multiple feedwater, product water, brine transfer, and treated water discharge pipelines associated with the WTP and STP systems. The project, covering approximately 26 hectares across portions 7, 10, 11 and 19 of the farm Pretorius Vley 374-IS and portion 2 and 5 of the farm Slagkraal 353-IS includes two pipelines between Tutuka Power Station and the Holding Dam (“HD”), the Slagkraal discharge pipeline and the STP discharge pipeline which will discharge treated water into a stream of the Slagkraal Spruit. NDC, a 34 300 hectare underground coal mine established in 1980, supplies coal to TPS and plays a critical role in South Africa’s power generation. The project aims to ensure efficient and sustainable water management to support ongoing operations at NDC and at TPS.

NDC holds two (‘2) existing Water Use Licenses (“WULs”):

1. Licence no.10/C11K/CFGIJ/4524 for Section 21 (a), (c), (f), (g) and (i) water uses and
2. License no. 08/C11K/G/2023 for Section 21 (g) water uses.

LEGISLATIVE REQUIREMENTS

Based on environmental sensitivities and Project activities the following application is being undertaken:

3. A WULA in terms of Section 21 of the NWA, for the following water use activities:

• Section 21(c): Impeding or diverting the flow of water in a watercourse.
• Section 21(f): Discharging waste or water containing waste into a water resource.
• Section 21(g): Disposing of waste in a manner which may detrimentally impact on a water resource.
• Section 21(i): Altering the bed, banks, course or characteristics of a watercourse.

APPLICATION STATUS

A pre-application meeting was held with the Licensing Authority, the DWS, on 17 November 2023, and a site visit with the DWS was undertaken on the same day and on the 14^th February 2024 and the 26^th February 2026. The application was submitted to DWS in March 2026 and is currently under review on the Electronic Water Use Licence Application and Authorisation System (“e-WULAAS”).

REGISTRATION AS AN I&AP

People have a right to be informed about activities and potential impacts that may affect them and to be afforded the opportunity to participate in and influence the decisions and outcomes of the proposed project. To register as an I&AP of this project, or to obtain more information or submit comments, please request a Registration Form from Shangoni and return it together with any comments to Shangoni by no later than 01^st July 2026 at the details provided below.

AVAILABILITY OF THE REPORTS

The Draft IWWMP and related documents are available to the public for review for a period of thirty (60) days, from 02^nd May to 01^st July 2026. Hard copies of the mentioned documents are available at the NDC security entrance. A register and comment sheet will accompany the hard copy at the public viewing station. Please complete the register after reviewing the report. Alternatively, submit your comments by e-mail or fax to Shangoni (details provided below) by no later than 01^st July 2026. An electronic copy of the Draft IWWMP and related documents will also be posted on Shangoni’s website (www.shangoni.co.za) for public comment for the same period as stated above.
