The Minister of Forestry, Fisheries and the Environment, published the National Environmental Management Laws (Administrative Penalties) Amendment Bill, 2026, for public comment.
The National Environmental Management Laws (Administrative Penalties) Amendment Bill seeks to supplement the criminal sanctions currently provided for in South Africa’s environmental law regime, by
introducing an administrative penalty system as additional means to discourage and penalise non-compliance with the NEMA and the specific environmental management Acts (“SEMAs”) that fall under the legislative framework of NEMA.
