PROTECTED/ THREATENED MARINE SPECIES

The Minister of Environmental Affairs published a list of marine species that are threatened or in need of protection in terms of section 56(1) of the National Environmental Management: Biodiversity Act 10 of 2004 (Column 1). Together with this, prohibited restricted activities relating to specific listed marine species in terms of section 57(2) have also been published (Column 2). Specific activities that are exempted from these restrictions in terms of section 57(4)(a) have also been published (Column 3). Threatened or Protected Marine Species Regulations have also been published.

So what for my operation?
Prior to conducting any activity involving a marine species, you should determine whether the species is protected or threatened and whether you should obtain a permit in terms of the National Environmental Management: Biodiversity Act 10 of 2004. Any restricted activity excluded from the prohibition in Column 2, or excluded from the exemption in Column 3, must be regarded as requiring a permit. Furthermore, any specific restricted activity relating to a specific listed threatened or protected marine species not included in either Column 2 or 3, must be regarded as requiring a permit.
