COMPENSATION FOR OCCUPATIONAL INJURIES AND DISEASES AMENDMENT ACT, 2022: COMMENCEMENT OF THE ACT  

Notice Title: Compensation for Occupational Injuries and Diseases Amendment Act, 2022: Commencement of the Act

Proclamation Notice: P 306 in GG 53990 on 23 January 2026

Commencing date: 23 January 2026, 1 February 2026 and 1 April 2026 depending on the specific section.

 

The President proclaimed the commencement of the Compensation for Occupational Injuries and Diseases Amendment Act, 10 of 2022 (“COIDAA”).

 

The commencement of COIDAA results in:

• The amendment of the Compensation for Occupational Injuries and Diseases Act, 130 of 1993, so as
  • to amend, substitute, insert, delete and repeal certain definitions and sections;
  • to provide for matters pertaining to the Board and its members;
  • to provide for the Commissioner to perform certain functions that were previously performed by the Director-General;
  • to further provide for matters pertaining to the rehabilitation, re-integration and return to work of occupationally injured and diseased employees;
  • to regulate the use of health care services;
  • to provide for the Commissioner to review pension claims or awards;
  • to provide for administrative penalties;
  • to regulate compliance and enforcement and
• to provide for matters connected therewith.

 

The commencement of the COIDAA will take place as follows:

1. 23 January 2026: subject to paragraphs (b) and (c), all sections of the COIDAA, with the exception of:
   1. section 1(g); and
   2. section 1(h) in so far as it relates to subparagraphs (i), (ii) and (iii) of the definition of “employee”,
2. 1 February 2026: Sections 3, 4, 5 and 6; and
3. 1 April 2026: Sections 19(a) and (b), 20(c), 28(c), 36(1), 50(3), 52, 54(1) and (2)
