COVID-19: AMENDMENT OF REGULATIONS PUBLISHED IN TERMS OF THE DISASTER MANAGEMENT ACT 57 OF 2002

The Minister of Cooperative Governance and Traditional Affairs, published a notice to amend the regulations published in terms of section 27(2) of the Disaster Management Act 57 of 2002 (published under GN 318 in GG 43107 of 18 March 2020). The amendments relate, inter alia, to the extension of the initial lockdown period and the relaxation of certain regulations and the expansion of essential services.
The amendments contained in Chapter 4 of the Government Notice are specifically applicable to the mining and energy sectors:
- Collieries that supply Eskom shall continue to operate at full capacity.
- Refineries shall operate at full capacity to avoid shortage of fuel, and such operations shall include refineries, smelters, plants and furnaces.
- Mining operations, including gold, gold refinery, coal and other mines, must be conducted at a reduced capacity of 50% during the period of the lockdown, and thereafter at increasing capacity as determined by the Cabinet member responsible for mineral resources and energy. Conditions will apply to the starting and increasing of capacity including rigorous screening and testing programs that must be implemented as employees return to work and quarantine facilities for employees who have tested positive for COVID-19.
