DISASTER MANAGEMENT ACT 57 OF 2002: DIRECTIONS ON THE ESTABLISHMENT OF A COVID-19 VACCINE INJURY NO-FAULT COMPENSATION SCHEME ISSUED IN TERMS OF THE ACT

Notice Title: Disaster Management Act 57 of 2002 (“DMA”): Directions on the establishment of a COVID-19 Vaccine Injury No-Fault Compensation Scheme issued in terms of the Act

Government Notice: GN 1987 in GG 46196 on 4 April 2022

Commencing date: 4 April 2022

The Minister of Health (“the Minister”), in terms of Chapter 8 of the Regulations made in terms of section 27 of the DMA (“the Regulations”), published the Directions on the establishment of a COVID-19 Vaccine Injury No-Fault Compensation Scheme (“the Direction”).

The Direction covers amongst other the following:

  • Administration of the Scheme;
  • Compensation for vaccine injury
  • Claims for compensation; and
  • Compensation.

How to ensure compliance at my operations?

In terms of regulation 93 of the Regulations, any person who has suffered a serious Covid-19 injury (permanent / temporary physical or mental impairment or death) caused by the administration of an applicable vaccine, or the dependent of a deceased person whose death resulted from the administration of an applicable vaccine, at an official vaccination site may be eligible for compensation from the Scheme.
