The Minister of Labour may by notice in the Government Gazette incorporate in the regulations made under the Occupational Health and Safety Act 85 of 1993 any health and safety standard or part thereof. In GN R735 in GG 32395 of 15 July 2009 specific standards were incorporated in the Pressure Equipment Regulations, 2009. This notice now amends the schedule with a new schedule, indicating additional health and safety standards incorporated in the Pressure Equipment Regulations, 2009. So what for my operation?
The effect of the incorporation of health and safety standards is that such standards are deemed to be regulations (after two months from incorporation). Therefore, compliance to all incorporated standards must be achieved. This would impact on original equipment manufacturers (OEMs), as well as personnel constructing, repairing or overhauling pressure equipment or pressurised systems.
