The Minister of Mineral Resources and Energy (“the Minister”), published the Mine Community Resettlement Guidelines, 2022 for implementation.

The purpose of the Guideline is to provide guidelines to be applied by an applicant or a holder of a prospecting right, mining right or mining permit when such application, prospecting right, mining right or mining permit will have the effect of resettlement of landowners, lawful occupiers, holders of informal and communal land rights, mine communities and host communities.

The Guideline outlines the process and requirements to be complied with by an applicant or a holder of a prospecting right, mining right or mining permit when such application or right will result in physical resettlement of landowners, lawful occupiers, holders of informal and communal land rights, mine communities and host communities, from their land.

How to ensure compliance at my operations?

Applicants or holders of a prospecting right, mining right or mining permit must take note of the Resettlement Guideline and use it when there may be a need for the resettlement of persons as provided for in the Guideline.
