Notice Title: National Environmental Management Act 107 of 1998 (“NEMA”): Consultation on the proposed documents which represent the Methodology for Determining the Financial Provision required to be set aside for Reconnaissance, Prospecting, Exploration and Mining of Low-Risk Commodities as Identified in the proposed Amendment to the Financial Provisioning Regulations, 2015 published under Government Notice No. 2272 in Government Gazette No. 47112 on 11 July 2022.

The Minister of Forestry, Fisheries and the Environment, in terms of section 44(1)(aE), (aF), (aG) and (aH), read with sections 24(5)(b)(ix), 24(5)(d), 24N, 24P, 24PA and 24R of the NEMA, consult on the documents which represent the methodology for determining the financial provision, required to be set aside for the rehabilitation and management of environmental impacts associated with final closure and post-closure of reconnaissance, prospecting, exploration and mining operations for low-risk commodities as identified in the proposed amendments to the Financial Provisioning Regulations, 2015 published under GNR 2272 on 11 July 2022, with the addition of prospecting operations which include the removal and disposal of minerals and mining rights.

The documents are entitled “Rehabilitation Plan Template for Operations Mining Low-Risk Commodities” and “Financial Provisioning Determination Spreadsheet and Master Rates”. The Rehabilitation Plan for Low-Risk Commodities Template consists of 22 pages and the Financial Provisioning Determination Spreadsheet and Master Rates, consists of 6 sheets. The documents have been prepared to reduce the complexity of determining the financial provision to be set aside for the reconnaissance, prospecting, exploration and mining operations which meet the criteria of being low risk operations as identified on the first sheet of the Financial Provisioning Determination Spreadsheet and Master Rates.
