Notice Title: National Environmental Management: Biodiversity Act 10 of 2004 (“NEMBA”): Regulations pertaining to threatened or protected terrestrial species and freshwater species

Commencing date: 1 April 2023

The Minister of Forestry, Fisheries and Environment (“the Minister”) made regulations pertaining to threatened or protected terrestrial species and freshwater species in terms of section 97 of NEMBA. These Regulations will take effect on 1 April 2023.

These regulations repeal the Threatened or Protected Species Regulations, GNR 150 of 23 February 2007.

How to ensure compliance at my operations?

Employers must take note of the new Regulations when intending to carry out any restricted activities involving specimens of listed threatened or protected species. The new Regulations also details the transitional arrangements in respect of permits and restricted activities that were issued and/or carried out in terms of the repealed Regulations.
