NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT 59 OF 2008: NOTICE CALLING UPON CERTAIN PERSONS TO APPLY FOR A WASTE MANAGEMENT LICENCE
Notice Title: National Environmental Management: Waste Act 59 of 2008 (“NEMWA”): Notice Calling Upon Certain Persons to Apply for a Waste Management Licence

Commencing date: 10 December 2025
The Minister of Forestry, Fisheries and the Environment, in terms of sections 80(4), 81(2) and 82 of the NEMWA, called upon the following persons to apply for a waste management licence, within two years from the date of this Notice (i.e. 10 December 2027), in accordance with the procedure prescribed in the NEMWA, and its Regulations:
(a) persons who operate a waste disposal facility, that was established before the coming into effect of the Environment Conservation Act, 73 of 1989 (“ECA”), where that facility was operational on the date of the coming into effect of the NEMWA;
(b) holders of a permit issued in terms of section 20 of the ECA, where the Minister is the licensing authority in terms of section 43 of the NEMWA; and
(c) persons who conducted a waste management activity listed in Schedule 1 of the NEMWA on the date of coming into effect of the NEMWA, and who immediately before that date lawfully conducted that waste management activity in compliance with GNR 91 of 1 February 2002.
The Notice does not apply to facilities with expired waste management licences or waste management
licences that have been suspended or revoked.
