NATIONAL HEALTH ACT 61 OF 2003: REGULATIONS RELATING STANDARDS FOR EMERGENCY MEDICAL SERVICES

Notice Title: National Health Act 61 of 2003 (“NHA”): Regulations relating standards for emergency medical services

Government Notice: GN 2819 in GG 47632 on 2 December 2022

Commencing date: 1 December 2023

The Minister of Health (“the Minister”) has under section 90(1)(m) of the NHA, and after consultation with the Office of Health Standards Compliance, made the Regulations relating Standards for Emergency Medical Services (“the Regulations”).

The Regulations includes amongst other, provisions on the following:

  • Definitions, application and purpose
  • User rights
  • Clinical governance and clinical care
  • Clinical support services
  • Leadership and governance
  • Operational management
  • Facilities and infrastructure
  • General provisions.

How to ensure compliance at my operations?

All Emergency Medical Service Providers must take note of these Regulations and take the necessary actions to align their practices with the provisions of the new Regulations before 1 December 2023 (i.e. 12 months after the date of promulgation of the Regulations).

In addition, employers making use of emergency medical service providers must also take note of the Regulations to ensure that their service providers comply with legal requirements.
