AMENDMENTS TO THE REGULATIONS REGARDING THE PHASING -OUT AND MANAGEMENT OF OZONE DEPLETING SUBSTANCES

The Minister of Environment, Forestry and Fisheries, has published a notice under sections 53(a) and (e), read with section 55 of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004), to amend the Regulations regarding the Phasing-Out and Management of Ozone Depleting Substances, 2014 (GN 351 in 37621 of 8 May 2014). How to ensure compliance at my operation?

Regulations 5A and 5B has been included into the Regulations to provide for import quota allocations and import and export permits for hydrochloroflourocarbons (“HCFC”).

Appendix A, that contains the List of Ozone Depleting Substances, has been substituted with a new List. The stockpiling of the ozone-depleting substances listed in Appendix A is prohibited and it is important to ensure that no such substances are stockpiled at an operation.
