The Minister of Forestry, Fisheries and the Environment, made the National Appeal Regulations, 2025 (“NAR”) which regulations pertain to the processing, consideration of, and decisions on appeals, in terms of sections 43, 44(1)(a), 44(1)(b) and 47 of the NEMA, for implementation.
The purpose of the NAR is to regulate the procedure contemplated in section 43 of the NEMA relating to the submission, processing, consideration of, and decisions on appeals in respect of the NEMA and any specific environmental management Act.
The NAR repeals the National Appeal Regulations, GNR 993 of 8 December 2014 and the National Environmental Management: Integrated Coastal Management Act Appeal Regulations, 2016, GNR 815 of 8 July 2016.
