The Minister of Forestry, Fisheries and the Environment, in terms of sections 32 and 53(p) of the National Environmental Management: Air Quality Act, 39 of 2004 (“NEMAQA”) repealed the Smoke Control Regulations made in terms of section 18(5) of APPA and Smoke Control Zone Orders made in terms of section 20(1) of the APPA.
The reason for the repeal is that the APPA has been repealed and the Regulations and Orders have become redundant.
