The Minister of Forestry, Fisheries and the Environment (“the Minister”), intents in terms of section 18(1) and (3), read with sections 72 and 73 of the NEMWA to require the producers of portable batteries to implement specified extended producer responsibility measures.
A producer of portable batteries (meaning a battery which is sealed, can be hand-carried without difficulty, and is neither an automotive nor industrial battery) will be required, amongst other, to establish an Extended Producer Responsibility Scheme in accordance with the provisions of the Extended Producer Responsibility Regulations, 2020.
