NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT 59 OF 2008: INTENTION TO AMEND THE LIST OF WASTE MANAGEMENT ACTIVITIES THAT HAVE, OR MAY HAVE, A DETRIMENTAL EFFECT ON THE ENVIRONMENT

The Minister of Forestry, Fisheries and the Environment (“the Minister”), intends to –
- amend, in terms of section 19(2)(b) and 19(3)(c) of the NEMWA, the List of Waste Management Activities that have, or are likely to have, a detrimental effect on the environment, as published in GNR 921 of 29 November 2013, as amended from time to time;
- provide for transitional arrangements as contemplated in section 19(3)(c) of the NEMWA; and
- deem the Regulations regarding the Planning and Management of Residue Stockpiles and Residue Deposits, GNR 632 of 24 July 2015, to have been made under the National Environmental Management Act, 107 of 1998 (“NEMA”).
The amendment of the List of Waste Management Activities that have, or are likely to have, a detrimental effect on the environment, through the removal of certain activities, is necessary as the affected activities are intended to be managed in terms of the NEMA.
The proposed amendment will affect the following waste management activities relating to the establishment or reclamation of residue stockpiles or residue deposits –
- by the deletion, in Category A, of activity (15); and
- by the deletion, in Category B, of activity (11).
