NATIONAL HEALTH ACT, 61 OF 2003: REGULATIONS RELATING TO ENVIRONMENTAL HEALTH

Notice Title: National Health Act, 61 of 2003 (“NHA”): Regulations relating to Environmental Health

Government Notice: GN 1885 in GG 46048 on 15 March 2022

Commencing date: Comments to be submitted by 14 April 2022

The Minister of Health intends, in terms of section 90(1)(a), (n) and (w), to make Regulations relating to Environmental Health (“the Regulations”).

The Regulations will cover amongst other the following:

  • Powers of Environmental Health Practitioners;
  • Compliance requirements for owners and occupiers specifically relating to the prohibition on causing public environmental health nuisances or hazards;
  • Environmental pollution control;
  • Premises;
  • Sanitation, including but not limited to the requirement to obtain a permit for certain identified offensive trades.
