NATIONAL WATER ACT 36 OF 1998: NOTICE TO UPDATE WATER USE INFORMATION IN TERMS OF THE ACT
Notice Title: National Water Act, 36 of 1998 (“NWA”): Notice to update water use information in terms of the Act

Commencing date: Applications to be submitted by 8 June 2023
In terms of regulation 11 of the Water-use Registration Regulations, GNR 1352 of 12 November 1999, the registered water must within one month of any change in the water use reflected in any registration certificate, report that change to the responsible authority.
The Minister of Water and Sanitation (“the Minister”) in his capacity as a responsible authority is instructing water users in writing to submit an application for an amendment or to submit a new application for registration for amendment within 90 days.
For purposes of the Notice, an amendment to the registration information as reflected on a registration certificate refers to formal or official changes made to information on the registration certificate.
Only official forms obtained from the website may be used.
No charge will be made for an application of amendment of water use, if the completed registration form is submitted within the 90 day period contemplated in the Notice.

How to ensure compliance at my operations?
As set out in section 21 of the NWA, the following water users should send an application for amendment of the registration of water use information as set out herein above:
- Taking water from a water resource (Section 21(a) of the NWA)
- Storing of water (Section 21(b) of the NWA)
- Engaging in a stream flow reduction activity contemplated in section 36 (Section 21(d) of the NWA)
The following water users are exempted from registration:
- A water user who falls under the area of operation of the water management institution water user association or irrigation boards or government water scheme. These water users should submit their application directly to their water management institution.
- Schedule 1 water users.
