OCCUPATIONAL HEALTH AND SAFETY ACT 85 OF 1993: NOTICE REGARDING IMPLEMENTATION OF REGULATION 8 OF THE COMMERCIAL DIVING REGULATIONS, 2022

Notice Title: Occupational Health and Safety Act 85 of 1993 (“OHSA”): Notice regarding implementation of regulation 8 of the Commercial Diving Regulations, 2022 (“CDR”)

Commencing date: 6 July 2022

The Acting Minister of Employment and Labour (“the Minister”) granted the following exemption in respect of the implementation of regulation 8 of the CDR:

  • Designated Medical Practitioners who currently do not have the qualification in occupational medicine to continue carrying out medical examinations.

The exemption is valid for a period of three (3) years (i.e. until 5 July 2025).

How to ensure compliance at my operations?

Designated medical practitioners carrying out medical examinations as contemplated in regulation 8 of the CDR must take the necessary actions to ensure that by the time of the expiration of the exemption:

  • They hold a qualification in occupational medicine; and
  • Has completed a course in underwater medicine through an organisation recognised by the Chief Inspector.
