OCCUPATIONAL HEALTH AND SAFETY ACT, 1993: AMENDMENTS TO THE ASBESTOS ABATEMENT REGULATIONS, 2020

The Minister of Employment and Labour (“the Minister”) has under section 43 of the OHSA, amended the AAR.

Amendments relate to:

  • Changes to the definition of the OEL for asbestos;
  • Competent person to provide training as contemplated in regulation 7(3) of the AAR no longer needs to be deemed competent by the Chief Inspector as was required by regulation 7(4)(a) of the AAR;
  • The requirement for the Chief Director: Provincial Operations to provide an acknowledgement of receipt as contemplated in regulation 10(5) in respect of the notification of asbestos work and as contemplated in 13(e) in respect of the submission of the plan of work by the approved inspection authority for asbestos work, have been deleted and is therefore no longer required.

How to ensure compliance at my operations?

Employers undertaking activities as an asbestos contractor or approved inspection authority for asbestos work must take note of the amendments.
