PROPOSED EXTENTION OF DEADLINE FOR COMPLIANCE WITH FINANCIAL PROVISIONING REGULATIONS, 2015 TO JUNE 2022

The Minister of Forestry, Fisheries and the Environment has published a notice of intention to amend the transitional arrangements contained in the Financial Provisioning Regulations, 2015, as amended (“the Regulations”). It is proposed in the notice to, once again, extend the date for existing holders to comply with the Regulations.

In terms of the proposed amendment to the Regulations holders of mining rights granted prior to 20 November 2015 will have until 19 June 2022 to comply with the Regulations, and shall, until this date, be regarded as having complied with the Regulations if compliant with the financial provisioning requirements applicable under the approved Mineral and Petroleum Resources Development Act, 2002 right.
