WITHDRAWAL OF THE SECTION 28 NOTICE CALLING FOR PAPER AND PACKING INDUSTRY, ELECTRICAL AND ELECTRONIC INDUSTRY AND LIGHTING INDUSTRY WASTE MANAGEMENT PLANS IN TERMS OF SECTION 28 OF THE NATIONAL ENVIRONMENTAL MANAGEMENT: WASTE ACT, 2008 (ACT NO. 59 OF 2008)

The Minister of Environment, Forestry and Fisheries notified members of the public of her decision to withdraw the section 28 Notice calling for Paper and Packaging Industry, Electrical and Electronic Industry and the Lighting Industry plans published under Government Notice No.1353 in Government Gazette No. 41303 on 6 December 2017 (the section 28 Notice) on 13 December 2019.
A number of plans were received in response to the aforementioned call for Industry management plans and upon consideration thereof, the Minister has reached the decision that none of them comply with the criteria expressly stipulated in the section 28 Notice and as a result none of them could be approved. The Minister is also of the view that a new approach is required in order to achieve the same objectives that were intended when this section 28 notice process initially began.
The new approach will be centered on the extended producer responsibility principle and would take into consideration the comments received from the relevant industries that generates the waste.
It is the intention of the Minister to have further engagements with the relevant industries that have been identified as generators of waste, on the specific extended producer responsibility measures that must be taken in respect of the product or class of products, as contemplated in section 18(1) of the National Environmental Management: Waste Act, 2008.
