RAILWAY SAFETY ACT, 30 OF 2024: REGULATIONS REGARDING RAILWAY OCCURRENCES TO BE REPORTED TO THE RAILWAY SAFETY REGULATOR, 2026

The Minister of Transport in terms of section 49(1) of the RSA published the draft Regulations regarding Railway Occurrences to be Reported to the Railway Safety Regulator for public comment.
The purpose of these Regulations is to ensure that notifiable railway occurrences are adequately managed within the operator’s Safety Management System and include-
- determining what constitutes a railway occurrence for the purposes of the RSA;
- the reporting of notifiable railway occurrences to the Regulator, within the manner required in the Regulations;
- management of all notifiable railway occurrences;
- the provision of all the information required by the Regulator as per these Regulations; and
- the management of the scene of a notifiable railway occurrence and the preservation of evidence where reasonably practicable.
