REGULATIONS TO PHASE-OUT THE USE OF PERSISTENT ORGANIC POLLUTANTS

Title: Regulations to phase-out the use, production, distribution, sale, import and export of persistent organic pollutants
Government Gazette Notice: GN 1150 in GG 42693 on 10 September 2019
Commencing date: 10 September 2019

The Minister of Environment, Forestry and Fisheries has published the abovementioned Regulations for implementation. The Regulations provide, inter alia, for phase-out time frames, notification to the Department of Environmental Affairs (“DEA”) and phase-out plans.  For a copy of the Regulations click here.

How to ensure compliance at my operation?

The Director General of the DEA must be notified, in a form obtainable from the DEA, on or before 10 October 2019 if any of the following Persistent Organic Pollutants (POP’s) are used, produced, distributed, sold, imported or exported:

  • Hexabromobiphenyl; 
  • Pentachlorobenzene;
  • Perfluorooctane Sulfonic Acids, its salts and Perfluorooctane Sulphonyl Fluoride;
  • Hexabromodiphenyl Ether and Heptabromodiphenyl Ether; and  
  • Tetrabromodiphenyl Ether and Pentabromodiphenyl Ether.
